Just like the terms ‘conservative-minded Tory Party MP’ and ‘dry water’, the phrase ‘deemed consent’ is an oxymoron. Presumed or deemed consent is not consent at all. Consent is given actively, not passively. You cannot presume it without doing away with the concept of consent.

Can we presume or deem consent when it comes to sex to reduce the number of rape cases? Or deem consent by car owners to reduce car theft? No, it doesn’t wash. Only using such extreme examples will people wake up to what ‘deemed consent’ really is – taking a liberty.
